In recent years it has become common to refer to litigation – or civil court matters – as “dispute resolution.” The term covers a number of dispute areas including commercial disputes.
The term was developed in line with directives given by the courts and judiciary that parties should make more concerted efforts to resolve their cases through negotiation. It is a requirement of the court process that parties discuss the possibility of settlement and try to avoid going to court. This has led to an increase in mediation – where the parties attempt to resolve their differences by referring them to a qualified mediator – with a view to resolving matters without the need for those matters to proceed to court.
