
Disputing the Will
Disputes over the distribution of a deceased’s estate under a will.
You may have concerns about your entitlement under a will — for example, if you’re being prevented from participating in the process, or a will has been destroyed, hidden, or has gone missing. It may be that someone who has passed away made no provision for you when you reasonably expected one — particularly common where a spouse or children who were financially dependent on them have been left out.
Delayed or Obstructed Administration
Sometimes a “caveat” (or stop) is placed on an estate to halt its administration. Delays like this can sometimes indicate an executor or administrator is trying to conceal something from the beneficiaries — often hoping that a fraud won’t come to light with time.
Disputes Before Death
Litigation can sometimes begin even before a person has passed away — for instance, where someone has applied undue influence to change a will, or where a person’s mental capacity to make decisions is in question.
